Error to Alpena; Emerick, J. Case by Louis Blanchard against the Detroit & Mackinac Railway Company for personal injuries. There was judgment for defendant on a verdict directed by the court, and plaintiff brings error.

Plaintiff was a brakeman, employed by defendant from 1897 to late in the winter of 1899, and again from February 15, 1900, to March 3d of the' same year, when he was injured. On April 10,1900, he again resumed work, and continued, at practically the same work as before, until March, 1902. When the injury occurred the locomotive was backing to make connection with a train of flat cars loaded with short logs. Plaintiff rode on the engine until it was within a few feet of the train.
