—In an action, inter alia, for a judgment declaring that the defendants unreasonably withheld consent to a proposed sublease, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Luciano, J.), entered August 7, 1987, which denied its motion to compel disclosure and, upon deeming the defendants’ cross motion to dismiss the complaint pursuant to CPLR 3211 (a) (1) and (7) as one for summary judgment pursuant to CPLR 3212, awarded the defendants summary judgment dismissing the complaint.
Ordered that the order is modified, on the law, by deleting the provision thereof…
