The above-styled appeal arose out of the Chapter 7 Bankruptcy proceedings of the appellant/debtor, Tracy M. Baker, Jr. On October 7, 1987, 79 B.R. 74, the Bankruptcy Court granted summary judgment to the appellee, the United States of America, acting through the Department of Labor, ruling that any debt owed to the United States by the debtor was non-dischargeable.
