MAYER, District Judge.

This is an application to amend a petition for naturalization, so as to base it on petitioner’s declaration of intention made April 12, 1899, and “for an order granting a certificate of naturalization upon the petition so amended.”

The facts bring up for construction certain provisions of a recently enacted statute and will be fully stated. Pollock, the petitioner, was born in Austria in 1866, and came to the United States in 1889, where he -has resided continuously ever since.
