Motion by the petitioner, The Buffalo Traction Company, to confirm the report of commissioners heretofore appointed by this court, which certifies that said railroad ought to be constructed and operated in East and West Utica street in the city of Buffalo.

Adams, J.:

On the 23d day of March, 1897, this court appointed three commissioners to determine whether a street surface railroad ought to be constructed and operated in East and West Utica street in the city of Buffalo. The order appointing such commissioners was made upon the application of the Buffalo Traction Company, such application being based upon a duly verified petition which stated, among other things, that the petitioner had obtained the consent of the local authorities of the city having control of those portions of the streets and highways upon which it was proposed to construct…
