IRENAS, District Judge.

Plaintiff Robert Courtney, a Medicare supplier, brings this action against Empire Medicare Services (“Empire”), a private Medicare insurance carrier under contract with the United States Department of Health and Human Services, to recover the balance of an amount allegedly due for medical services provided to Ronald Chop-lin, a medicare beneficiary and a co-defendant in this action.
