On November 14, 1921, O. T. Wheeler, defendant in error, hereinafter called plaintiff, and L. E. Holloway, plaintiff in error, hereinafter called defendant, executed a contract, whereby it was agreed in substance that they would make a mutual exchange of property. Under said contract Wheeler was to convey to Holloway 150x105 feet at the corner of North Nineteenth street and West avenue in Waco, and Holloway was to convey to Wheeler two tracts of land described in the contract and one Ford car.
