This appellant was tried in the court below upon an indictment containing two counts. Count 1 charged him with the offense of distilling, making or manufacturing alcoholic or spirituous liquqrs or beverages, contrary to law. Count 2 in proper form and substance charged him with the possession of a still, etc., to be used for the purpose of manufacturing alcoholic or spirituous liquors or beverages. The jury returned a verdict of guilty as charged in count 1, which operated as an acquittal of the charge contained in count 2 of the indictment. No rulings of the court were invoked pending the…
