PONDER, Justice.

The plaintiff has appealed from a judgment dismissing his petition for the interdiction of his brother, Ernest G. Toca.

*471Ernest G. Toca attended school in Washington, D. C. for some three years, during which time he returned home on vacations. He was committed to a mental institution on June 27, 1930 by an order of the Supreme Court of the District of Columbia because he was found to be of unsound mind.
