This is an action of contract to recover, under the first count of the declaration, for rent of premises in the city of Cambridge alleged to have been leased to the defendant, and under the third count for damages claimed to have arisen from the occupation of the premises so leased. The second count was waived. The trial judge directed a verdict for the plaintiff on the first count; the third was submitted to the jury, who returned a verdict for the plaintiff.'
