Baptist Health Richmond, Inc. petitioned the Court of Appeals for a writ prohibiting the Madison Circuit Court from enforcing its order requiring Baptist Health to produce certain documents that had been requested in discovery by the real party in interest. The Court of Appeals denied the petition, and Baptist Health appeals from that denial. The issue on appeal is whether the requested documents are protected from disclosure by the Patient Safety and Quality Improvement Act of 2005 (the Act), 42 U.S.C.A. § 299b-21 et. seq.
