Plaintiff sued defendant in a justice of the peace court for $87.64, on account of overcharges paid to defendant. Plaintiff, whose place of business is Omaha, Nebraska, purchased from defendants, whose place of business is Hastings, Nebraska, a certain shipment of rubber, including tires, inner tubes, etc., and when a draft therefor arrived plaintiff paid the same, which amounted to $123.55.
