—In an action to recover damages for *1018personal injuries, the plaintiffs appeal from an order of the Supreme Court, Nassau County (McCarty, J.), entered November 21, 2008, which granted the defendant’s motion for summary judgment dismissing the complaint on the ground that neither of the plaintiffs sustained a serious injury within the meaning of Insurance Law § 5102 (d), and denied, as academic, their cross-motion for leave to file a note of issue.

Ordered that the order is affirmed, with costs.
