In this summary proceeding, which has already been *409dismissed, respondent is moving for an order granting him reasonable attorney’s fees incurred in the successful defense of a nonprimary residence proceeding which petitioner commenced against him. Respondent’s motion, made returnable in New York County, was referred to this court because the court had previously entertained respondent’s motion for, inter alia, an order dismissing the petition and granting attorney’s fees.
