GARRETT, Chief Justice.

Appellant, Walter C. Jones, brought suit against appellee, Oscar Johnson, alleging, that by reason of his ownership of the land forming the’southern shore of Highland Bay or Cove, in Galveston County, and by reason of planting and growing the same, as well as by right of prescription, he was the exclusive owner of all the oysters and oyster beds in certain portions of said bay or cove; that appellee had wrongfully appropriated part of said oysters, and threatened to continue to do so.
