The accident out of which this action arose occurred in the city of Davenport. At the time of the accident, the appellee’s ward was a boy seven years of age. South Howell Street in said city runs in a general northeasterly and southwesterly direction. The Chicago, Milwaukee & Saint Paul railroad track runs in a generally east and west direction, and near the place in question approaches South Howell Street on an embankment, and crosses said street on a viaduct.
