The defendant, Comer Finch, was tried on an indictment charging him and his brother, C. T. Finch, with the offense of assault with intent to murder in that they did unlawfully, etc., “with hands and fists, and other blunt instrument being to the grand jurors unknown, the same being a weapon likely to produce death,” commit the assault upon one Lonnie Williams with the intent to kill him, etc. On the trial of the case, the evidence showed that the victim, a man 65 years of age and who had had a stroke and was partially paralyzed on the right side, went to the home of the…
