Appeal from Floyd, District Oourt. The defendant was indieted, tried and convicted for the crime of murder, and sentenced to eighteen years in the penitentiary. He appeals.

I. The indictment is as follows: “ The grand jury of the county of Floyd, in the name and by the authority of the State of Iowa, accuse Frederick Zeibart and Julius Zeibart of the crime of murder, committed as follows: The said Frederick Zeibart and Julius Zeibart, on the seventh day of December, in the year of our Lord one thousand eight hundred and seventy-two, in the county aforesaid, in and upon one S. 0.
