This is an action for personal injury claimed to have been caused by an automobile accident. There was a verdict for the defendant upon which judgment for dismissal was duly entered. Thereafter a motion for a judgment notwithstanding the verdict or for a new trial was denied and the plaintiff appealed from the order denying the motion for a new trial and from the judgment of dismissal. The appeal from the order denying the new trial was not made within the statutory time and as there was no motion for a directed verdict at the close of all the testimony the only errors which can be considered…
