OPINION

LEECH, Special Justice.

This suit is an attack upon the validity of an ordinance of the City of Memphis which annexed certain territory thereto pursuant to T.C.A. § 6-309. Having analyzed the testimony of witnesses, statement of counsel and memoranda on points of law, the Chancellor dismissed the suit holding that the annexation ordinance in question was not so unreasonable and unnecessary as to be an arbitrary and oppressive exercise of the city’s legislative power. As a result of this holding, the complainants filed a motion for a new trial which was subsequently argued and denied.…
