We consider here the computation and payment of the attorney fees and costs owed by a workers’ compensation payor upon receiving reimbursement from the proceeds of a compensation recipient’s separate action for damages against a third party. In the present case, the circuit court of St. Clair County assessed fees and costs against only the amount of the lien that the compensation payor could claim for its past compensation payments, and did not assess fees and costs on the amount of future compensation payments that the payor was relieved from making by virtue of the recipient’s recovery.
