Appellant, Harold Sutton, appeals a judgment by the Franklin County Circuit Court finding him liable on a debt to plaintiff, Petry Roofing Supply, Inc. (Petry). Appellant alleges five points of error. First, appellant claims that the trial court erred in not dismissing the instant case because a prior suit by Petry against appellant’s wife was dismissed for failure to prosecute in the Circuit Court of Crawford County.
