Blenis v. Utica Knitting Co.

Action to recover damages for the obstruction of a lane or alleyway by a building of the defendant, and to compel the defendant to remove the building. At the close of the evidence defendant moved for a non-suit and the plaintiff for a direction of a verdict, and the court took the case by consent of counsel for consideration.

The facts out of which this case arose may be briefly stated as follows:
On the 31st day of December, 1889, one Edward D. Mathews became the owner by purchase at sheriff’s sale of a considerable tract of land in the city of Utica, M..Y., which he shortly thereafter caused to be laid out in blocks and lots by numbers, and streets and avenues by name. This map, in lots subsequently sold by him, he referred to as being one which was filed in his own office and known as “ Map Mo. 2 of Utica Highlands.” The map in question was not filed in the clerk’s office of Oneida county by Mathews, but it was…
