The question in this case for the court to decide is one of jurisdiction ratione materiae, the suit having been brought in the Parish of St. Mary, and the parties who were cited and excepted, reside in the Parish of Orleans.

The exception to the jurisdiction of the court having been sustained, *137and the suit dismissed with reference to said parties, the plaintiff prosecutes this appeal.
