In a negligence action to recover damages for personal injuries, defendant Christie appeals from an order of the Supreme Court, Queens County, dated July 8, 1961, which denied his motion for summary judgment and severance of the action as against him. Order reversed, on the law, with $10 costs and disbursements, and motion granted. Plaintiff was a passenger in appellant’s automobile, which was involved in a multi-car collision.
