Martin, J.:

The information charged that the defendant “ on the 26th day of October, 1922, at the City of New York, in the County of New York, unlawfully did engage in the business of reselling tickets of admission to a theatre and place of amusement, and did resell to one John Cunniff a ticket of admission to a certain theatre and place of amusement called Palace Theatre, without first having obtained the necessary license therefor, from the Comptroller of the State of New York as required by law.” The defendant was convicted and sentenced to pay a fine of twenty-five dollars, or in default…
