This is an action for declaratory and injunctive relief relating to the plaintiff’s compelled retirement from his employment as an attorney-hearing examiner for the Department of Industry, Labor and Human Relations of the State of Wisconsin (DILHR). Jurisdiction is present. 28 U.S.C. § 1343(3); 42 U.S.C. § 1983. Because plaintiff seeks to enjoin the enforcement and execution of §§ 41.11(1), 41.02(23), and 42.531 of the Wisconsin Statutes, with respect to the rule of compulsory retirement at age 65 embodied in those statutes, on the ground that this statutory…
