BRECKENRIDGE, Judge.

This appeal involves a probate proceeding in which the personal representative filed a petition for a declaratory judgment that a “last will addendum” written by the decedent failed to bequeath one-half of his estate to Marilyn Steele, either as a codicil or as a list disposing of items of tangible personal property. In response, Ms. Steele filed a counterclaim and a third-party petition alleging that she and the decedent’s parents had en*602tered into an oral agreement to distribute decedent’s estate in accordance with the last will addendum.
