Defendant John Daniel Ketzner, Jr., was convicted in a jury trial of first-degree murder in violation of MCLA 750.316; MSA 28.548. He was sentenced to life imprisonment. He filed a motion for a new trial which was denied in trial court and has now taken this appeal as of right. The pertinent facts in the case are as follows.
