Action, for damages for personal injuries alleged to have been suffered by plaintiff while she was a passenger upon one of defendant’s street ears in the city of St. Liouis. Prom a judgment for plaintiff in the sum of $10',000, defendant has appealed.

While the motion for new trial charged error in the refusal of the trial court to give to the jury a peremptory instruction to find for defendant at the conclusion of all the evidence, no such assignment of error is made in defendant’s brief here.
