SUMMERS, Chief Justice.
This is an action arising out of a collision between two trucks at a highway intersection.
Appellee Dyer Fruit Box Manufacturing Company (Dyer) as plaintiff sued appellant Victor Ozuna for damages to its truck allegedly caused by Ozuna’s negligence in driving out from a stop sign into the path of Dyer’s truck which had the right of way.
