This was a suit by the appellee against the appellant, in a complaint of two paragraphs, to recover damages for injuries sustained by a certain bay horse, *501owned by the appellee, on the appellant’s railroad. To each of the paragraphs of said complaint, the appellant’s demurrer for the want of sufficient facts was overruled by the court, and its exceptions were duly saved to these decisions. The appellant then answered by a general /denial of the complaint.

The issues joined were tried by a jury, and a verdict was returned for the appellee, assessing his damages in the sum of one hundred and…
