BAZELON, Chief Judge:
Appellant was convicted in 1972 of armed robbery and assault with a dangerous weapon. After serving more than two years in prison, he was paroled. Shortly after the trial ended, evidence was developed that indicated that a person whom appellant claimed to have been with prior to the alleged crime — a person whom the Government’s rebuttal evidence had suggested did not exist — was, in fact, with the appellant.
