Appeal by the defendant City of Albany from a judgment entered upon a verdict rendered by a jury at a Trial Term of the Supreme Court, Albany County, and from an order denying defendant’s motion to set aside the verdict. Plaintiff-respondent was injured when the automobile in which he was a passenger, owned and operated by the codefendant Collins, was involved in a collision with a police car at the intersection of State and Lark Streets in the city of Albany.
