MEMORANDUM OPINION AND ORDER

On April 14, 1984, plaintiff Atari, Inc. (“Atari”) filed this diversity action against defendant Harris Trust & Savings Bank (“Harris”), advancing claims of negligence and of wrongful dishonor of a letter of credit issued by Harris. Harris subsequently moved to dismiss all claims and Atari responded with a cross-motion for summary judgment.
