The only issue on this appeal is between the plaintiff, H. C. Edelman, and the defendant, J. I. Case Company, who will be referred to respectively as plaintiff and defendant. The plaintiff commenced this action to determine apparently conflicting rights in certain lands located in Hutchinson County, South Dakota, and the proceeds from the sale thereof. The defendant answered asserting rights in this land by virtue of a certain judgment which defendant had obtained against the plaintiff in May, 1932, and a levy and sale thereunder.
