Theft of a horse is the offense; penalty assessed at confinement in the penitentiary for five years.
R. W. Johnston lived in the northeast part o'f Castro County where he was engaged in farming. On or about the 4th day of March, 1935, he owned a black stud horse which was two and one-half years old, about fifteen and one-half hands high and weighed about 1200 pounds.
