The issue in this appeal is whether section 704(a) of Title VII of the Civil Rights Act of 1964 (42 U.S.C. § 2000e-3(a) (1976)) prevents an employer from dismissing an employee whose job, is handling discrimination complaints when the employee handles those complaints in a manner contrary to the instructions of the employer. Paul L. Whatley, plaintiff-appellant, claims he was discharged by defendant-appellee, Metropolitan Atlanta Rapid Transit Authority (MARTA), for sending a complaint to a federal agency charging MARTA with sex and race discrimination.
