Plaintiff Aaron W. Foster, Sr., employed by defendant City of St. Paul (“the City”), was suspended without pay following his indictment for murder in November 2007. Foster filed this suit, alleging that the City’s suspension constituted race discrimination in violation of the Minnesota Human Rights Act, the federal Constitution, and the common law doctrine that an individual is innocent until proven guilty.
