Introduction

In this action for damages arising out of professional malpractice, judgment creditor, Peggy Ann Vetter (“Vetter”) entered into a Miller-ShugaH agreement with judgment debtor, Leo Subotnik (“Subotnik”). Under the terms of the agreement, Vetter may collect the judgment only from Subotnik’s insurer, St. Paul Fire & Marine Insurance Company (“St. Paul”). Vetter now moves the Court to grant summary judgment against St. Paul.
