J. S. Scott filed this suit against American Employers' Insurance Company to set aside an award of the Industrial Accident Board and to recover compensation insurance for total and permanent incapacity alleged to have been sustained while in the employ of the Sedwick Oil Company. The petition alleged the necessary jurisdictional and other facts necessary to show a right of recovery, including allegations that plaintiff's average weekly wage before the injury was $56.25, for which compensation was claimed for 401 weeks at $20 a week.
