The judgment appealed from was rendered March 30, 1906. On September 21,1906, plaintiff filed with the clerk of this court a transcript of the pleadings and judgment of the district court, and also a purported original bill of exceptions which had not then been authenticated. This court has been at no time requested to permit the bill of exceptions to be withdrawn for the purpose of having it authenticated, or for any other purpose, notwithstanding which, there now appears upon the bill the filing mark of the clerk of the district court indicating that it was filed in his office…
