Tom Cochran in the circuit court of Mobile County, in equity, against the City of Mobile, a municipal corporation, et al., in which members of the Water Works Board of the City of Mobile, and said Water Works Board in its corporate capacity, intervened with permission of the trial court, the circuit court rendered a declaratory decree that the complainant, acting in his official capacity as a member of the Board of Water and Sewer Commissioners, was not an officer or employee of the City of Mobile in its corporate capacity; and,…
