Defendant was convicted in the district court of Carlton county of selling intoxicating liquor potable as a beverage, and appeals from an order denying a new trial.
Three questions are presented:
When the canse was called for trial in June, 1925, defendant interposed a challenge to the panel of petit jurors on the ground that three of the persons included in the jury list for the year 1925 had also been included in the jury list for the year 1924 and had served as jurors in that year.
