Appellants Gary Batze, Carlo Cesar and Justin Hayes brought suit against their employer, Safeway, Inc., and The Vons Companies, Inc., for failure to pay overtime wages. Appellants claimed that in their positions as first and second assistant managers (AMs) for respondent’s stores they had been required to work long hours performing such nonmanagerial tasks as stocking shelves, checking customers’ purchases and building product displays.
