MEMORANDUM OPINION AND ORDER

LATCHUM, Chief Judge.

On January 22, 1975 the Grand Jury returned a three count indictment against John K. Whiteside, charging a violation of 26 U.S.C. § 7201. The indictment charges that Whiteside had been employed by Arthur D. Henry on three occasions to prepare a joint income tax return for Henry and his wife for the calendar years 1968, 1969 and 1970, that Whiteside had obtained money from Henry for the payment of the income taxes due for each calendar year, and that Whiteside had knowingly and willfully attempted to evade and defeat the payment of the tax due…
