In an action, inter alia, to recover damages for medical malpractice, etc., the plaintiffs appeal from a judgment of the Supreme Court, Queens County (Hart, J.), entered July 30, 2008, which, upon an order of the same court dated May 20, 2008, granting the defendant’s motion pursuant to CFLR 4401 for judgment as a matter of law made at the close of the evidence, is in favor of the defendant and against them dismissing the complaint.

Ordered that, on the Court’s own motion, the notice of appeal from the order dated May 20, 2008, is deemed a premature notice of appeal from the judgment (see CFLR…
