OPINION

ZAPPALA, Justice.

Brian C. Moore stands charged with rape, statutory rape, indecent assault, and corruption of minors, with respect to an incident that occurred in August of 1986. After the case was set for trial, the Allegheny County District Attorney filed in the Commonwealth Court a Petition for Access to Confidential Information, pursuant to 42 Pa.C.S. § 8723. The Petition asserted that the Commonwealth had reason to believe that Moore had received treatment for gonorrhea at the Allegheny County Health Department in August of 1986.
