This is an action of trespass on the case brought by the R. A. Watson Orchards, Inc., the appellant, for its own use as well as for the use of two insurance companies, who have not joined in the appeal against The New York, Chicago & St. Louis Railroad Company, the appellee, to recover damages for the destruction of the appellant’s cold storage plant, located at Neoga, Illinois, and the contents thereof, claimed to have been set fire by the negligent operation of the appellee’s locomotive engines.
