OPINION OF THE COURT
Memorandum.
Judgment of conviction modified on the law and facts by vacating the convictions for menacing in the third degree and harassment in the second degree, and dismissing said charges; as so modified, affirmed.
Prior to the start of trial, defense counsel made a Sandoval motion whereupon it was noted that defendant had no prior arrests or convictions. The trial court did not make a Sandoval ruling.
